Indian REACH is India’s chemical regulation currently in a draft stage, known as the Draft Chemicals (Management and Safety) Rules, 20xx, or CMS Rules. The rules are due to enter into force this year, and will regulate chemicals currently in use and those transported into, or manufactured in, India. The new law will cover notification, registration, restriction and prohibition of chemicals. As well as labelling and packaging requirements related to the use of substances, including those in mixtures and articles, and intermediates placed, or intended to be placed, on the market in the country in quantities above one tonne/year.
Under the CMS Rules, foreign entities can submit priority substance notifications and annual updates, registrations and more by appointing an authorised representative in India to fulfil the necessary legal obligations. In addition, local companies must comply with hazardous chemicals management requirements.
The Bureau of Indian Standards (BIS) is a national body and its 2016 act on Rules and Regulations aim to give customers a third-party guarantee on quality, safety and reliability of products.
This act, along with subsequent 2018 regulations, address the provision of a Grant of Licence (GoL) for both domestic and foreign manufacturers of chemical products listed in Scheme I of the 2016 act.
India's regulation of 54 imported chemicals from January 2022 means that such a licence must be obtained within 180 days of the date of their entry into the country as defined in a Quality Control Order (QCO(s)).
Foreign manufacturers can submit an application for a licence using an authorised Indian representative. Domestic manufacturers also need to submit an application under this rule.
