  3. Modernisation of Cosmetics Regulation Act (MoCRA)

    • the Modernisation of Cosmetics Regulation Act (MoCRA), enacted in December of 2022, is the most significant regulation overseeing cosmetics in the United States, since the implementation of the Food, Drug and Cosmetics Act in 1938; 
    • MoCRA has numerous provisions, including facility registration and product listing, mandatory recall authority, adverse events, safety substantiation, labeling (specifically professional use), records access, records inspection, and testing method for asbestos in talc-containing proposed rule, which have statutory dates of December 29, 2023. Other provisions, such as Good Manufacturing Practice, labeling (for cosmetic products and fragrance allergen labeling), and PFAS in cosmetic products, have later statutory dates; and
    • the purpose of this presentation will be to provide: (1) an overview of MoCRA and its major provisions and (2) a status update on the work being conducted at FDA to implementation MoCRA.

    • people of colour may be exposed to hazardous ingredients in beauty and personal care products more frequently, potentially contributing to disproportionate adverse health outcomes;
    • increasingly, research and policy efforts have focused on this disparate exposure and solutions for addressing products; and
    • The Clean Beauty Justice roadmap provides guidance to retailers and product manufacturers to eliminate this inequity
