If you have mixtures with a health or physical effect classification on the market in the European Union, and they have not been notified with the individual Member States poison centres, then you may be out of compliance - leaving you at risk of enforcement action.
European Poison Centre legislation is a complex regulatory area with each Member State having their own implementation of article 45 of CLP - their poison centre legislation.
Annex VIII to CLP was released in March last year with the intention of harmonising these variations. However, the obligation to notify mixtures in Member States has existed for many years and the recent publicity around the Annex has not only increased awareness but also enforcement.
Our partner, the National Chemical Emergency Centre (NCEC), is notifying mixtures, biocides and detergents on behalf of some of the world’s largest chemical companies and have been tracking the recent crackdown in the enforcement of poison centre notifications across Europe.
