An update of REACH Substance Evaluation court decisions

During the webinar, Andew Fasey summarised two important recent judgements of the General Court. These judgements follow actions taken by Germany and BASF against two decisions of the ECHA Board of Appeal (BoA). The BoA decisions were taken following appeals against two ECHA substance evaluation decisions.
The actions challenged the technical content of the two BoA decisions and, more importantly, the scope and powers of review of the BoA. As BoA is part of ECHA, the challenge to the scope of review of BoA also has major implications for ECHA’s powers under the substance evaluation process.
