FIFRA is a complicated law of critical importance to many industries including, but not limited to, the food and agricultural sectors of the global economy, and the business of pesticides is central to those sectors’ successes. For the purposes of FIFRA, a pesticide is defined as “any substance or mixture of substances intended for preventing, destroying, repelling or mitigating any pest.” FIFRA defines a “pest” broadly to include “(1) any insect, rodent, nematode, fungus, weed, or (2) any other form of terrestrial or aquatic plant or animal life or virus, bacteria, or other micro-organism (except viruses, bacteria, or other micro-organisms on or in living man or other animals).”
The FIFRA product approval process is protracted, and often challenging, for any given product. Further complicating matters are the ensuing — often expensive — data, recordkeeping and advocacy requirements associated with obtaining FIFRA product approvals and maintaining those registrations. State pesticide programs are also important, and increasingly a part of the commercial process in states beyond California and New York.
